Personal data: any information concerning an identified or identifiable person. MONTANSTAHL through the website, collects various personal data: name, surname, e-mail address, telephone number, IP address of the user’s device connected to the Internet. 
Processing: any operation concerning personal data, regardless of the means and procedures used, namely the collection, recording, storage, use, modification, communication, archiving, deletion or destruction of data. 
Data subject: the natural person whose personal data is being processed. By way of example, the interested party is the user who navigates on the platform and sends for example, through the same, a request for information. 

PIWIK PRO
We use Piwik PRO Analytics Suite as our website/app analytics software and consent management tool. We collect data about website visitors based on cookies. The collected information may include a visitor’s IP address, operating system, browser ID, browsing activity and other information. See the scope of data collected by Piwik PRO.
We use this information to calculate metrics such as page views, bounce rate, sessions, traffic sources and website interactions to understand and improve the usage and performance of our website.  
We host our solution on Microsoft Azure in Germany and the data is stored for 25 months. 
The purpose of data processing: analytics and conversion tracking based on consent. Legal basis: Art. 6 (1)(a) GDPR. 
Piwik PRO does not send the data about you to any other sub-processors or third parties and does not use it for its own purposes. For more, read Piwik PRO’s privacy policy.

LEAD FORENSICS
We use Lead Forensics, a B2B website visitor identification service provided by Lead Forensics Ltd. When visitors access our website, the Lead Forensics technology may process technical information generated during the visit, including the visitor’s IP address and information relating to the pages visited. Lead Forensics compares IP address information against its proprietary business database in order to identify organisations visiting our website and provide us with business-level website visit information. 
We use this information to understand interest in our products and services, analyse B2B website activity and support our business development activities. 
We use the standard Lead Forensics tracking code, which is a JavaScript technology and does not automatically place the Lead Forensics lfuuid cookie. 
Lead Forensics acts as a processor in connection with this processing. Further information about the processing arrangements and safeguards is available in the Lead Forensics Data Processing Agreement. 
Data processed: IP address and technical website interaction information. 
Purpose: identification of organisations visiting our website and analysis of B2B website activity. 
Legal basis / justification: Legitimate interests pursuant to Article 6(1)(f) GDPR, namely MONTANSTAHL AG’s legitimate interest in identifying organisations that visit its website, understanding business interest in its products and services, analysing B2B website activity, and supporting its sales and business-development activities. MONTANSTAHL AG has assessed that this processing is necessary for these purposes and that its legitimate interests are not overridden by the interests, fundamental rights or freedoms of the individuals concerned.

PURPOSES / GROUNDS OF JUSTIFICATION	DATA RETENTION
a) Browsing the website, viewing content and technical management of the operation of the platform.  To operate the website, the computer systems used acquire personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes IP addresses or domain names of computers and terminals used by users, URI/URL (Uniform Resource Identifier/Locator) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment. grounds of justification: overriding/legitimate interest of the Data Controller	until the duration of the browsing session
b) Contact or Information Request: to provide feedback to requests for information and/or requests for quotes. MONTANSTAHL AG has assessed that this processing is necessary for these purposes and that its legitimate interests are not overridden by the interests, fundamental rights or freedoms of the individuals concerned.  *data is retained for the duration of our Lead Forensics service agreement and is deleted or returned upon termination in accordance with the applicable Data Processing Agreement and contractual terms, unless continued retention is required or permitted by applicable law.	2 years

The personal data provided will be communicated to subjects who will process personal data as data processor, as persons acting under the authority of the Data Controller or as individuals acting under the authority of the Controller or the Processor for the purposes listed above. Specifically, personal data will be communicated to recipients belonging to the following categories:

(i) subjects that provide services for the management of the information system used by  MONTANSTAHL AG and of the telecommunications networks (including e-mail);
(ii) subjects supporting the Data Controller in the management of web platforms (e.g. hosting provider, SEO consultancy provider);
(iii) studies or companies in the context of assistance and consultancy relationships;
(iv) competent authorities to fulfill legal obligations and/or provisions of public bodies, upon request. The list of data processors is constantly updated and available at the headquarters of the Data Controller.

5. Communication of Data Abroad

MONTANSTAHL may disclose personal data to service providers located outside Switzerland where this is necessary for the purposes described in this Privacy Notice. 
Where personal data is transferred to a country recognised as providing an adequate level of data protection under Swiss law, the transfer is made on that basis. Where the recipient country does not provide an adequate level of protection, MONTANSTAHL implements appropriate safeguards, such as recognised standard contractual clauses, unless another statutory exception applies. 
Our principal website and analytics hosting infrastructure is located in Germany. Certain service providers may process or access personal data from other jurisdictions in accordance with the applicable contractual and legal safeguards.

Under the conditions set out in the FADP and EU Reg. 2016/679 the Data Controller acknowledges the following rights (non-exhaustive list):

• to request that data processing be stopped, that its disclosure to third parties be prevented, or that personal data be corrected or destroyed.
• the right to demand that a certain processing of personal data be prohibited, that a certain communication of personal data to third parties be prohibited or that personal data be deleted or destroyed.
• if neither the correctness nor the inaccuracy of the personal data can be proved, to request that a note be added to the data noting its disputed nature.
• to request that the rectification, destruction, blocking, in particular the communication to third parties, as well as the mention of the disputed character or the judgment be communicated to third parties or published.
